Outline for University-wide Disciplinary Committee Proceedings (Non-Title IX)
Hearings generally proceed according to the following format and are managed by the Committee Chair:
- Introduction of all parties present and clarifications of roles
- Acknowledgement of expectations for support people (if applicable)
- Reminder to all present that:
- Falsification, distortion, or misrepresentation before the Committee is a violation of University policy
- Disciplinary proceedings are distinctly different from the legal-judicial processes of the general society
- Expectations on confidentiality
- Statement of the allegation(s) about which the Committee is inquiring to determine what may have happened and whether sanctions are to be imposed
- Respondent is given an opportunity to accept responsibility for all, some, or none of the allegations
- Committee members ask questions of:
- Complainant (Respondent given the opportunity to submit written questions for the Committee to consider for Complainant)
- Respondent (Complainant given the opportunity to submit written questions for the Committee to consider for Respondent)
- Witnesses (if applicable)
- Investigator (if applicable)
- Follow-up questions of any person
- Complainant is given an opportunity to make a final statement (up to 8 minutes)
- Respondent is given the opportunity to make a final statement (up to 8 minutes)
- The next steps in the process are explained
At the completion of the proceeding, all present who are not members of the Committee will be asked to leave. The Committee members then deliberate to determine if a preponderance of the information does or does not support a violation of University Policy. If the Respondent is determined to have violated University Policy, the Committee will determine a sanction. The Respondent and Complainant are simultaneously notified in writing of the outcome within 14 days of the proceeding.
